Nochi, LLC (“Nochi”, “Company”, “we”, “our”, or “us”) greatly recognizes the importance of personal information and strives to protect the privacy of people (“you” or “User”) who use or access any of our applications (“App(s)”), websites, or other services that we operate (collectively, our “Services”). This Privacy Policy applies to all of our services and describes how we handle and protect the information we receive through our services. By accessing and using our services, you acknowledge that you have read, understood, and agree to the following terms stated in this Privacy Policy.

WE WILL ALERT TO ANY CHANGES MADE BY POSTING THE EFFECTIVE DATE OF THE LATEST VERSION ABOVE, AND WILL NOT BE HELD LIABLE TO ANY CHANGES MADE DURING THIS BETA PERIOD. IT IS YOUR RESPONSIBILITY TO REVIEW AGAIN WHEN THE APP IS RELEASED FOR THE MOST UP TO DATE PRIVACY POLICY, AS YOUR CONTINUED USE OF OUR SERVICES WILL CONSTITUTE TO YOUR CONTINUED AGREEMENT.

  

2. Personal Information: What We Collect

Unless obtaining your express and additional consent in advance and for specific circumstances, we will not collect personally identifiable information (PII) or sensitive personal information (SPI), such as real name, address, and/or fax number. You acknowledge and agree that if you elect to submit any personal data, such personal data would be subject to this Privacy Policy and you agree with all the terms therein.

-Usage of the App

-User Service Information

3. Personal Information: Purpose of Use

In order to improve and enhance user experience of our services, we may use the collected information for the following purposes:

Nochi’s legal basis to process your personal data include:

-The legitimate interests of the company, which include improving service quality and user experience

-Compliance with Nochi’s legal obligations 

-User consent. Under any circumstance where the basis is consent for the collection or processing of your personal data, such consent may be subsequently withdrawn at any time without affecting the validity and lawfulness of collection or processing based on the consent before its withdrawal.

4. Personal Information: When it is Shared

In the following cases, there are times when the company may disclose your personal data:

(1) Within Nochi

(2) Other Users: If you choose to link your information to social media sites like Facebook, it may be viewed by users of such sites.

(3) Corporate Transactions: In the event that the company performs a merger, transfer of business, or otherwise disposes of any amount of business, assets, or stock (in the event of acquisition, bankruptcy, or other similar events), your personal data may be transferred over to the successor.

(4) Legal Purposes: The company may disclose personal information at the request of a government body, public agency, or the like when it is required by law or needed for cooperation with the relevant authorities. We will also disclose information if we reasonably believe that it is necessary to protect the health or safety of you, another person, or the public. In order to protect the rights of ourselves and others, we may also disclose data needed to bring legal action in the case of violations against the Terms of Service, third-party rights, or otherwise laws and regulations of your country of residence.

(5) Third-Party Services: The company works with a number of (if any) third-parties on or through our services to help us provide services and functionalities to you. We do not sell your personal data and only share data that is non-personally identifiable on its own, aggregated, or public with third-parties under the following necessary circumstances, and such third-parties thereof are prevented from processing (including but not limited to accessing, storing, using, or disclosing) your personal data except for achieving the purpose of their cooperation with us.

Do note that this Privacy Policy does not and will not pertain to any third-party services that may be available while accessing our services. Be sure to go and review their respective privacy policies.

5. Our Policy Regarding Children

Our services are not intended for children under the legal age of majority in their country of residence (“Minor”). We do not knowingly collect any personal information from minors nor knowingly allow minors to use our services without parental consent or otherwise permitted by applicable law. If you are a minor, please do not send any information about yourself to us, including your name, address, telephone number, or e-mail address. In the event that we learn that we have collected information about a minor, we will delete that information as quickly as possible. Cookies are small text files that are generated when you visit a website and are automatically stored in your browser or device. A unique ID from the cookie file makes a user identifiable, allowing us to identify repeated users of our services. It also can track site usage, allowing us to analyse how users use our services, including user traffic data and devices used. The traffic data that we collect is done anonymously and is not personally identifiable.

We use cookies, web beacons, and other similar technologies for the following purposes:

(1) Analytics and Research: Cookies help us collect information about what visitors are doing on our services, including which sections are most popular.

(2) Service Performance: Cookies allow us to collect information about service performance, helping us to make improvements to our services.

(5) Objection: You have the right to object to our processing of your personal information. To the extent provided by applicable laws and regulations, you may withdraw any consent you previously provided to us for certain processing activities.

(6) Process Restriction: You have a right to require us to stop processing the personal information we hold about you other than for storage purposes in certain circumstances. Please note, however, that if we stop processing the personal information, we may use it again if there are valid grounds under data protection laws for us to do so (for example, for the defence of legal claims or for another’s protection). As above, where we agree to stop processing the personal information, we will try to tell any third party to whom we have disclosed the relevant personal information so that they can stop processing it too.

Do note that there may be cases where you may not be able to use all or part of our services if you choose to engage with any of the above.

We maintain reasonable and appropriate physical, electronic, organizational, and procedural safeguards to protect your information. While we take reasonable precautions against possible loss, misuse, or unauthorized access, no storage system or transmission of data over the Internet can be guaranteed to be secure. Data we collect will be retained only for so long as reasonably necessary for the purposes set out above, unless applicable law requires otherwise.
